€71,250 Compensation for Man Hit by Flying Bottle Outside Nightclub

On a warm June evening, Mindaugas and his girlfriend U gne decided to go to a nightclub in Dun Laoighaire. There were lots of people drinking inside and outside the nightclub at the trestle tables. There was loud music inside. On the way out of the nightclub, Mindaugas stopped to wait for Ugne and spotted Pavel, his Polish friend. Pavel was working security at the nightclub. Mindaugas walked over to talk to him. Suddenly and without warning, a bottle flew through the air. Pavel saw it coming and ducked. Mindaugas was behind Pavel and the bottle hit his lip and nose. Mindaugas was taken by ambulance to hospital where he received 6 stitches in his upper lip and 4 stitches in his nose.

It turned out that Pavel had thrown a man called Bill out of the nightclub as he had been causing trouble earlier in the night. After Bill was thrown out he went away, but came back some time later. When Bill saw Pavel, he picked up a pint bottle from the trestle table on the terrace and threw it at Pavel. Pavel saw the bottle coming and ducked. The bottle hit Mindaugas, who was standing behind him. Mindaugas contacted John Griffin, solicitor, in relation to the accident. The nightclub accepted no responsibility for the accident as it was not their fault that Bill threw the glass.

The case was heard and defended fully in the High Court. In the course of evidence in the court case, it turned out that the trestle  ables were full of glasses and empty bottles. The judge found that the nightclub was responsible because they did not have a proper system in place for cleaning up glasses and bottle left on the trestle tables. The judge awarded Mindaugas €71,250. However, Mindaugas was left with a badlooking scar on his lip and nose.
