
It was a dark August night. Mary was on her way back to the caravan. She had been out with her friends at a restaurant. She was walking back to the caravan park. The caravan park is at the end of a long, single-lane roadway. There is a footpath to the right-hand side. There was no lighting on the private roadway owned by the caravan park. Mary was walking along the footpath. She tripped and fractured her right ankle. It turned out that building work was being carried out on the footpath but no proper signage indicating that works were in progress was in place.
An application was made into the Injuries Board. The Injuries Board refused to assess the claim. Court proceedings were issued in Wexford Circuit Court. Just prior to the hearing the matter was settled for €31,250. The client was worried about responsiblity for the accident and was happy with the settlement.
