Probate Made Simple

At Griffin Solicitors we break down the Probate process into smaller parts, set time limits for each part and work from appointment to appointment in order to ensure that Probate is completed as soon as possible.

Probate involves proving the deceased’s will, identifying and collating their assets, submitting returns to the Revenue Commissioners, collecting and distributing these assets to the beneficiaries, and producing estate accounts.

Obtaining a Grant of Probate involves the following steps:

  1. Locating the will and identifying the executors.
  2. Identifying all the assets and debts in the estate. This can be a difficult task when the deceased invested in many areas or invested online with passwords and not paper left a paper trail.
  3. Filling out a return to Revenue, preparing an Oath for the executor(s) and lodging these documents with the Probate Office
  4. Dealing with any query raised by the Probate Office.
  5. Issuing the Grant of Probate from the Probate Office.
  6. Gathering in the assets of the deceased, including selling property where required.
  7. Obtaining written confirmation from the Department of Social Welfare and HSE that they do not have any claim over the estate for non contributory old age payment or under the Fair Deal scheme.
  8. Dealing with taxation issues of non-resident beneficiaries.
  9. Preparation and finalisation of estate accounts.
  10. Distributing the assets of the estate.
  11. Payment of inheritance tax by beneficiaries.

As this is a sequential process a delay at any one step may distrupt the timeline of the whole process.  To find out more about the probate process click here.

John and his team are an absolute pleasure to deal with - from the moment you walk in you are made feel welcome and at... ease. John helped guide me through probate after the death of my wife and made everything from start to finish totally seamless. I have also used Griffin Solicitors for some other services (affidavit for daughters passport, wills etc). Always looked after and always so professional. I would not hesitate to recommend them to family and friends who may need their professional services.read more
